Power Buyer Service
Registration Agreement
This registration agreement, including all documents incorporated into this registration agreement by reference, ("Agreement") governs your use of this Power Buyer Service website ("Website") that is provided by GEMSA Loan Services, L.P., d/b/a Power Buyer Service ("Power Buyer Service," "We" or "Our"). By clicking "Accept" and then using the website, you acknowledge that you have read this agreement, understand it and represent that you have the authority to bind your company ("You" or "Your") to this agreement.
The Program. By accepting this Agreement and becoming a registered user of the Website, Power Buyer Service will allow You to access information provided by Power Buyer Service and its participating vendors ("Vendors"), to transmit information to Power Buyer Service and Vendors (collectively, "Your Information") and to participate in the Power Buyer Service program as more fully described in the Website (the "Program"). You acknowledge that the Program is not designed for the participation of governmental entities.
Access, Use and Disclosure. In order to participate in the Program, You must have accepted this Agreement and obtained a password from Power Buyer Service. You represent and warrant that: (1) You are duly authorized to access the Website, participate in the Program, and provide Your Information; (2) You will not permit any other person to use Your password and (3) You will not use or disclose to any person any information obtained through the Website or Program if such use or disclosure (a) violates any applicable law or (b) violates any obligation of confidentiality to which You are subject.
Consideration. The Program provides a valuable benefit to You because of the functionality, products and services made accessible to You through the Program. You agree that this valuable benefit is sufficient consideration for Your agreements and obligations set forth in this Agreement. Further, You acknowledge that a Vendor may pay Power Buyer Service a referral fee or other financial benefits after the Vendor is referred to You through the Program.
Terms of Use. Your use of the Website is subject to the Website’s Terms of Use , which are incorporated herein by this reference. All provisions of the Terms of Use apply to the body of this Agreement as if fully stated herein, including without limitation the following provisions:
Privacy Policy. Your privacy and Power Buyer Service’ collection from You and use of data while You use the Website are subject to the Website’s Privacy Policy , which is incorporated herein by this reference.
Termination. You acknowledge that Power Buyer Service may terminate this Agreement, including Your participation in the Program, at any time and for any reason.
Disclaimer. Power Buyer Service is a service of GEMSA Loan Services L.P. and should not be considered to be endorsed by any of GEMSA's lenders or investor clients.
